The products for sale on the site www.dannywise.com (the “Site”) are sold and invoiced by DANNY WISE s.r.l., having its registered office in Via S. Caterina 4, 93100 Caltanissetta, Italy company registered with the C.C.I.A.A. of Milan, Tax Code and P.I. 02031460856 (“DANNY WISE”).

GENERAL CONDITIONS OF SALE
1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT
1.1 DANNY WISE offers for sale on the Website www.dannywise.com the products to final consumers, that is, to adults who purchase for purposes not related to their own commercial, entrepreneurial or professional activity, possibly carried out (the “Customer”). DANNY WISE therefore reserves the right not to process orders from subjects other than the “Customer”.
1.2 The contract stipulated between DANNY WISE (hereinafter also the “Seller”) and the Customer must be considered concluded with the acceptance, even if only partial, of the order by DANNY WISE. In case of non-acceptance, DANNY WISE will promptly notify the Customer.
1.3 By placing an order in the various ways provided, according to the order form on the Site (hereinafter, the “Order”), the Customer must read all the information provided to him during the purchase procedure and fully accept the these general conditions (hereinafter the “Conditions”).
1.4 These Conditions may be printed or saved on a durable digital medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and by art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
2. PURCHASE METHOD
2.1 The products offered for sale by DANNY WISE are only those present on the Site at the time the Order is placed, as described in the relevant information sheets.
In any case, it is understood that the images accompanying the description of a product are for information purposes only and may not be perfectly representative of its characteristics, but differ – for example – in color and size (also due to the browser and monitor. used to access the Site and view images).
2.2 The Customer, to place an Order, must fill in all its parts the relevant form on the Site and send it following the instructions on the Site itself, after having carefully read these Conditions, as well as the characteristics of the product and / or products that intends to purchase, the relative price (including all applicable taxes or duties) and the shipping costs (including any additional costs to be incurred for choosing a faster and / or different type of shipping and delivery from the standard one). The Customer can request an invoice from Customer Service after receiving the shipping confirmation email only if at the time of purchase he has clicked on “Do you want to request an invoice?” and entered the tax code.
2.3 DANNY WISE will confirm the correct receipt of the Order by replying via e-mail, sent to the e-mail address supplied by the Customer. This confirmation message will contain the General Conditions of Sale and briefly the information on the Right of Withdrawal and therefore all the information contained in the commercial and contractual conditions viewed before placing the Order (the main characteristics of the product, the information details on the price, payment terms, return methods and shipping costs) so as to allow the Customer to review this information.
2.4 DANNY WISE may not be able to process orders that are incomplete or inaccurate or in case of unavailability of the products. In such cases, DANNY WISE will inform the Customer of the failure to conclude the contract, specifying the reasons.
If the products for sale on the Site are no longer available at the time of receipt of the Order by the Seller, the Seller will inform the Customer as soon as possible.
In the event of an Order concluded and a price already paid for a product that is no longer available, the Seller will reimburse the Customer, without undue delay, the amount paid and the contract concluded between the parties will be considered terminated.
3. PRICES AND PAYMENT METHODS
3.1 The prices indicated on the Site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the Site.
3.2 Purchases can only be made by credit card or debit card, with PayPal or with the other methods that may be indicated on the Site, on a case by case basis (such as Payment on Delivery). It should be noted that no additional costs are envisaged in relation to the payment method chosen.
3.3 In case of payment made by credit card or debit card, the financial information (such as, for example, the card number and / or the expiry date) will be sent by encrypted protocol to Banca Sella or to another banking institution, which provides the related remote electronic payment services, without third parties being able to know them in any way. This information will also be used by the Seller only to follow up on the purchase or for any refund procedure in the event of a return, following the exercise of the right of withdrawal or to report any fraudulent commission to the police.
3.4 In no case and at no stage of the payment will DANNY WISE be able to know the information relating to the Customer’s credit cards, which will be directly transmitted via a secure connection to the website of the bank that manages the transaction. DANNY WISE will not keep such data in any computer archive and therefore in no case can it be held responsible for any fraudulent and improper use of credit cards by third parties upon payment.
3.5 The price of the products for sale and the shipping and delivery costs indicated in the Order form will be charged to the Customer only following the shipment of the products themselves. In case of cash payment (if the Payment on Delivery service is active), the price must be paid at the time of delivery. 3.6 Cash on delivery is not accepted for orders with customized items.
4. DELIVERY OF PRODUCTS AND SHIPPING COSTS
4.1 The purchased products will be delivered to the address indicated by the Customer in the Order, by DANNY WISE and its logistics service providers, at the cost specifically indicated on the Site before sending the Order. 4.2 The delivery times of the products may also vary with respect to what is posted on the site, for reasons not attributable to DANNY WISE and not obvious by it. Upon delivery of the products, the Customer is required to sign the delivery note after having duly checked:
4.2.1 that the number of packages delivered corresponds to what is indicated in the transport document.
4.2.2 that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps).
4.3 Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately detected, putting a specific indication on the product delivery document to be returned to the courier.
4.4 Any problems concerning the physical integrity, correspondence or completeness of the products received should be reported within 7 days of delivery to allow DANNY WISE to proceed with the appropriate checks. In any case, the above does not affect in any way the right of return or the legal guarantee on the product.
4.5 The purchased products are supplied with an identification tag with the disposable seal, both of which are necessary in case of returning the goods.
5. COLLECTION IN THE BOUTIQUE
5.1 As an alternative to delivery, the Customer may decide to directly collect the products purchased at the DANNY WISE Boutiques, which provide the delivery service (for more information, visit the following link.
5.2 The complete list of the Boutiques participating in the collection service is available on the Site. In this case, the arrival of the products will be communicated to the Customer via email and he will have 15 days from receiving the communication to collect them (for all information relating to this service, you can consult the “Collection in boutique” or “Boutique service” section. “In the Customer Service area. After 15 days the product is considered as not delivered and the sales contract must be considered terminated for all purposes, with reimbursement of the price paid by the Customer.
5.3 It is not possible to pay in cash at the time of collection for this type of order, as delivery by the courier is carried out in the boutique.
6. RIGHT OF WITHDRAWAL AND RETURN
6.1 The Customer has the right to withdraw from the purchase contract for any reason, without giving reasons and without any penalty, within 14 (fourteen) days from the date of delivery of the products.
6.2 To exercise the right of withdrawal referred to in paragraph 6.1 above, the Customer must use the appropriate form available at the following link, or use the paper return form.
6.3 In case of withdrawal, the Customer must return the products to DANNY WISE within 14 (fourteen) days of the withdrawal, according to one of the following methods:
6.3.1 sending of the products to be returned to the address indicated in the Return Form via the courier chosen by DANNY WISE and indicated in the same form (UPS). The products can be shipped using the pre-printed and prepaid document contained in the product shipping package. This method of return will be borne by the Seller and will not entail any cost for the Customer. Please contact UPS (or visit www.ups.com) to arrange a pickup;
6.3.2 sending the returned product / products to the address indicated in the Return Form by courier chosen and appointed directly by the Customer (in this case, the Customer will bear all shipping costs);
6.3.3 delivery of the product / products being returned to the address indicated in the Return Form (the Customer must deliver the product / products being returned together with the Return Form, also showing suitable identification documentation);
6.3.4 in case of collection of the goods directly in the Boutique, the Customer can return the products to the same Boutique.
6.4 The goods must be returned intact, together with the original packaging (including any accessories, labels, tags, tags, seals, etc.) and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without any signs of wear or dirt, in compliance with the following conditions:
• the right of withdrawal may apply to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (including the accessory equipment: labels, tags, tags, seals, etc …).
• for the cases indicated in points 6.3.2, 6.3.3. and 6.3.4, the shipment of the products, until the certificate of receipt by DANNY WISE, is under the full responsibility of the Customer. Therefore, in case of damage to the products during transport, DANNY WISE will notify the Customer, so as to allow him to promptly file a complaint against the courier and obtain the relative reimbursement; the product will then be made available to the customer, simultaneously canceling the request for withdrawal or indicating to the customer the decrease in value of the asset and the relative reimbursement;
• DANNY WISE will not be liable in any way for damage, theft, loss occurring during or in any case depending on the return shipment if the same occurred in the manner referred to in points 6.3.2, 6.3.3 and 6.3.4.
6.5 DANNY WISE will refund the Customer the full amount paid within 14 (fourteen) days from the date of withdrawal. DANNY WISE may suspend the refund until the returned product is received or until the Customer proves that he has correctly returned the product, whichever is earlier.
6.6 Unless otherwise agreed, DANNY WISE will refund the Customer the full amount paid, using the same payment method used by the Customer. In case of cash payment, the amount will be returned by bank transfer, using the bank details indicated by the Customer in the Return Form. In any case, the Customer will not be charged any cost for the return.
6.7 After the return of the products, DANNY WISE will make the necessary checks relating to their compliance with the conditions and terms indicated in this document and if the checks are not concluded positively, it will communicate to the Customer, via e-mail, the found existence of a decrease in the value of the returned products, resulting from failure to comply with the aforementioned conditions. At the same time, DANNY WISE will communicate the amount that will be deducted from the refund, without prejudice to the possibility, alternatively, for the Customer to get back, at his own expense, the products in the state in which they were returned to DANNY WISE.
6.8 In the event of forfeiture of the right of withdrawal for any reason, DANNY WISE will return the purchased product to the sender, charging the shipping costs to the sender and, if already reimbursed, the price of the product.

7.1 All products sold by DANNY WISE are covered by the legal guarantee of 24 (twenty-four) months for lack of conformity, pursuant to Title III of Legislative Decree no. 206/2005. For more information, you can consult the Right of Withdrawal and Legal Guarantee.
7.2 The warranty for lack of conformity operates only for products used correctly, in accordance with their purpose and the washing instructions contained on the label or otherwise supplied with the product.

10. APPLICABLE LAW
10.1 The sales contract referred to in these Conditions and its execution is governed by Italian law, with the non-application of the conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the Customer’s municipality of residence will be competent for the solution of the relative disputes.
10.2 In the event of disputes arising from the Conditions, the online alternative dispute resolution body of the Milan Chamber of Commerce (www.risolvionline.com) may also be consulted in advance.

11. CHANGES AND UPDATES
11.1 These General Conditions of Sale may be modified from time to time, also following any name changes. The new General Conditions of Sale will be effective from the date of publication on the Site.dannywise
